This Privacy Notice applies to personal information we process as an independent controller when you visit Kai, create or administer an account, accept a Kai agreement, arrange payment, or communicate with us. It does not describe Customer Personal Data we process on Customer’s behalf through a Customer Application. The Kai Terms and Kai Privacy Notice govern Kai; general public k-id.com terms or notices do not govern Kai where they conflict with this Kai-specific package.

‍

  1. How We Use Personal Information

We use personal information to:

  • Provide Kai. We use your personal information to fulfill our contract with you or the organization that engaged you and provide you with Kai. For example, we use your email address to create, authenticate, administer, and secure Kai accounts and organizations, provide the Kai console, SDK/API access, support, documentation, and requested features;
  • Communicate With You. We use your personal information to fulfill our contract with you, answer your queries, communicate about service changes, security matters, account notices, support, and transactional updates;
  • Improve and Develop Kai. We use personal information about you to improve, upgrade, enhance Kai and communications, to develop new products and services by measuring engagement in our Services, to ensure internal quality control, safety, reliability, integrity and to debug and otherwise identify and repair errors with Kai. For example, we use usage information to assess trends and usage across Kai to help us determine what new features our users may be interested in. When we process your personal information for this purpose, we do it on the basis of our legitimate interest.
  • Secure and Protect Kai and Users. We use your personal information on the basis of our legitimate interest to detect, investigate and prevent security incidents, defend us against legal claims or disputes, enforce our agreements and policies and carry out activities that are required to comply with our legal obligations. For example, we protect Kai and our users against malicious, deceptive, fraudulent, illegal activity, or product abuse.
  • Market and Promote Kai. We use your personal information to advertise, market and promote our Services and other offerings. For example, with your consent, we use your email address to send you information about our Services that we think may be of your interest such as our newsletters.

‍

  1. How We Share Personal Information

We may share personal information with the following categories of recipients:

  • Service providers and subprocessors that help us provide the identified Kai production stack, such as hosting, infrastructure, communications, payment processing, customer support, security, and related services. The Kai-specific provider and subprocessor snapshot made available with the applicable legal package identifies the relevant providers, purposes and locations. A general public list may not describe every Kai-specific controller-side provider.
  • Affiliates that support the provision, administration, security, or improvement of our Services.
  • Your organization and authorized account administrators, where you use Kai for or through an organization.
  • Professional advisers, auditors, insurers, and financial institutions where reasonably necessary for legal, compliance, audit, or business purposes.
  • Competent authorities, law enforcement, courts, or other third parties where we reasonably believe disclosure is required by law, necessary to protect rights, safety, or security, or to investigate fraud or abuse.
  • A buyer, successor, or other participant in a corporate transaction, such as a merger, acquisition, restructuring, financing, or sale of assets, subject to applicable law.

We do not sell personal information or share personal information for advertising or profiling purposes.

‍

  1. Customer Data and Children’s Information

Kai is intended for adult developers and business users. Do not create a Kai account if you are under 18. We do not knowingly collect Kai Account Data directly from children.

A Customer Application may use Kai to process information about its own end users, including children, to provide age-aware experiences. In that context, the Customer is responsible for its own privacy notices, legal basis, consent, and compliance obligations. Our current public privacy policy explains more about our general processor role and age-assurance practices at https://k-id.com/privacy-policy.

‍

  1. International Data Transfers

All information processed by us may be transferred, processed, and stored anywhere in the world, including, but not limited to, the United States or other countries, which may have data protection laws that are different from the laws where you live. We endeavor to safeguard your information consistent with the requirements of applicable laws.

If we transfer personal information which originates in the European Economic Area, Switzerland, and/or the United Kingdom to a country that has not been found to provide an adequate level of protection under applicable data protection laws, we rely on the EU Standard Contractual Clauses and similar international transfer mechanisms to support such transfer as required by law.

‍

  1. Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information. Our security and privacy center, including information about controls and subprocessors, is available at https://security.k-id.com/. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your credentials confidential and using Kai in accordance with our security requirements.

‍

  1. Retention

We retain your personal information while your account is active and thereafter for as long as necessary to fulfill the purpose(s) for which it was collected, e.g. to provide you with Kai, maintain legally required agreement and billing records, resolve disputes, establish or defend legal claims, conduct audits, prevent abuse, and comply with legal obligations.

‍

  1. Your Privacy Choices and Rights

Depending on where you live, you may have rights to access, correct, delete, restrict, object to, or receive a portable copy of personal information that we process as controller. You may also have the right to withdraw consent where processing is based on consent and to complain to the competent data-protection authority.

To exercise your rights, contact privacy@k-id.com. We may need to verify your identity and authority before responding.

‍

  1. Additional Information for U.S. Residents

In the preceding 12 months, we may have collected the categories described in Section 2: identifiers and contact information; commercial and transaction information; internet, device, and usage information; professional or employment-related information; and inferences or account preferences. We collect this information from you, your organization, your device/browser, and service providers. We use and disclose it for the purposes and to the categories of recipients described in Sections 3 and 4.

We do not sell personal information or share it for cross-context behavioral advertising. We do not knowingly sell or share the personal information of individuals under 16. California residents may request information about our practices or exercise applicable rights by contacting privacy@k-id.com. Authorized agents may submit requests where permitted by law, subject to verification of authority and identity.

‍

  1. ‍Changes to This Notice

We may update this Privacy Notice to reflect changes to Kai, our practices, or applicable law. When we post changes, we will update the “Last Updated” date, preserve the historic version, and provide notice as required by law. Where a material change requires consent or a new legal acceptance, we will obtain it before applying the change where required. A change to the Customer’s declared application data flow is handled under the Customer’s Kai Live readiness process and Direct Data Notice, not by this controller notice alone.
